O pot ser que us passi tot el contrari i que la vostra inexperi\u00e8ncia faci que aneu una mica perduts pel que fa a tenir perfecta consci\u00e8ncia de quins s\u00f3n els vostres drets b\u00e0sics com a treballador. <\/p>\n<p>Doncs b\u00e9, avui \u00e9s el vostre dia de sort, perqu\u00e8 a Woffu ens hem proposat elaborar un r\u00e0nquing dels vostres <strong>drets laborals b\u00e0sics m\u00e9s importants com a treballador<\/strong>. Alguns no els haur\u00edeu de deixar passar mai per alt. Altres us sorprendran de veritat. Un salari que, d&#8217;altra banda, s&#8217;ha de fer en la data indicada en el contracte. Puntualment i sense excepcions. Si l&#8217;empresa incompleix sistem\u00e0ticament aquesta obligaci\u00f3, incorrer\u00e0 en una falta greu, que pot costar-li una multa d&#8217;entre 6.251 i 187.515 euros.   <\/p>\n<p>Una altra q\u00fcesti\u00f3 important t\u00e9 a veure amb el salari vinculat a la categoria professional. Si us contracten com a t\u00e8cnic de laboratori perqu\u00e8 teniu una especialitat concreta, <strong>us hauran de pagar com a tal<\/strong>. Aix\u00f2 \u00e9s, tenint en compte el que diu el conveni col\u00b7lectiu del vostre sector. No seria la primera vegada que en una empresa contracten alg\u00fa dins de la categoria d&#8221;auxiliar&#8217;, en lloc de la posici\u00f3 que en realitat li correspon i amb el salari que li correspon.   <\/p>\n<h2><span class=\"ez-toc-section\" id=\"Dret_laboral_2_Indemnitzacio_en_cas_dacomiadament\"><\/span>Dret laboral #2: Indemnitzaci\u00f3 en cas d&#8217;acomiadament<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Tothom s&#8217;ho ha preguntat alguna vegada: si deixo la feina tinc dret a indemnitzaci\u00f3? <strong>La liquidaci\u00f3 exigeix una indemnitzaci\u00f3?<\/strong> La resposta \u00e9s no. Quan es duu a terme una liquidaci\u00f3 i l&#8217;empresa prepara el que s&#8217;anomena &#8216;liquidaci\u00f3&#8217; no estem parlant en cap cas d&#8217;indemnitzaci\u00f3. En realitat, el que l&#8217;empresa us pagar\u00e0 ser\u00e0 el que us deu en funci\u00f3 dels dies treballats en el mes en qu\u00e8 es finalitzi el contracte, aix\u00ed com els diners corresponents a les vacances no gaudides o a les pagues extra.  <\/p>\n<p><img decoding=\"async\" class=\"alignnone wp-image-12887 size-full\" src=\"https:\/\/woffu.com\/wp-content\/uploads\/2022\/05\/derechos-laborales-2.jpg\" alt=\"\" width=\"1280\" height=\"720\" srcset=\"https:\/\/woffu.com\/wp-content\/uploads\/2022\/05\/derechos-laborales-2.jpg 1280w, https:\/\/woffu.com\/wp-content\/uploads\/2022\/05\/derechos-laborales-2-300x169.jpg 300w, https:\/\/woffu.com\/wp-content\/uploads\/2022\/05\/derechos-laborales-2-1024x576.jpg 1024w, https:\/\/woffu.com\/wp-content\/uploads\/2022\/05\/derechos-laborales-2-768x432.jpg 768w\" sizes=\"(max-width: 1280px) 100vw, 1280px\" \/><\/p>\n<p><strong>S\u00ed que teniu dret a una indemnitzaci\u00f3 en cas d&#8217;acomiadament o si s&#8217;acaba el contracte<\/strong>. Tant si l&#8217;acomiadament \u00e9s procedent com improcedent, el que se us pagar\u00e0 podr\u00e0 ser el seg\u00fcent: <\/p>\n<ul>\n<li>8 dies per any: contractes signats des del 31\/12\/2011<\/li>\n<li>9 dies per any: contractes signats des de l&#8217;1\/1\/2012<\/li>\n<li>10 dies per any: contractes signats des de l&#8217;1\/1\/2013<\/li>\n<li>11 dies per any: contractes signats des de l&#8217;1\/1\/2014<\/li>\n<li>12 dies per any: contractes signats des de l&#8217;1\/1\/2015<\/li>\n<li>20 dies per any: contractes: contractes indefinits<\/li>\n<\/ul>\n<h2><span class=\"ez-toc-section\" id=\"Dret_laboral_3_Els_descansos\"><\/span>Dret laboral #3: Els descansos<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><strong>Sab\u00edeu que el dret al descans \u00e9s intocable?<\/strong> La nova Llei de temps i assist\u00e8ncia que des de fa uns mesos han de complir totes les empreses evita, en gran mesura, que hi hagi mala fe en aquest sentit, tant del costat del treballador com de l&#8217;empleador. <a href=\"https:\/\/woffu.com\/ca\/\" target=\"_blank\" rel=\"noopener noreferrer\">Woffu ofereix un sistema de control horari i pres\u00e8ncia<\/a> que facilita el registre de les hores que duen a terme els treballadors d&#8217;una empresa. Sigui com sigui, la llei diu que si la jornada \u00e9s de sis o m\u00e9s hores seguides, <strong>cal fer un descans m\u00ednim de 15 minuts<\/strong>. <\/p>\n<p>A m\u00e9s, la jornada laboral dels treballadors no ha d&#8217;excedir les 9 hores di\u00e0ries. En cas que aix\u00ed sigui, <strong>teniu dret que l&#8217;empresa us pagui les hores com a &#8216;extraordin\u00e0ries&#8217;<\/strong>. Hores que, d&#8217;altra banda, res tenen a veure amb les hores &#8216;complement\u00e0ries&#8217;. Aquestes \u00faltimes s\u00f3n les hores que treballador i empresari han pactat en un contracte, perqu\u00e8 el primer pugui fer m\u00e9s hores de les que s&#8217;estipulen per a la jornada ordin\u00e0ria en contractes a temps parcial.   <\/p>\n<p>Sigui com sigui i per no fer-vos un embolic, \u00e9s convenient que consulteu el que diu el vostre conveni, ja que <strong>les hores complement\u00e0ries no poden superar el 15% de les hores ordin\u00e0ries<\/strong>. \u00c9s un altre dels vostres drets i no l&#8217;heu de passar per alt. <\/p>\n<h2><span class=\"ez-toc-section\" id=\"Dret_laboral_4_La_promocio_i_la_formacio\"><\/span>Dret laboral #4: La promoci\u00f3 i la formaci\u00f3<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>En els temps que corren pocs han de ser els treballadors que no tenen en compte les possibilitats de promocionar-se i rebre formaci\u00f3 a c\u00e0rrec de l&#8217;empresa amb l&#8217;objectiu de superar-se tant en el terreny professional com en el personal. I encara que sembla que estem davant d&#8217;un privilegi, res m\u00e9s lluny de la realitat. <strong>Sab\u00edeu que com a treballador teniu dret a la promoci\u00f3 i a la formaci\u00f3?<\/strong><\/p>\n<p>Si b\u00e9 \u00e9s possible que hi hagi empreses que no ofereixin cap d&#8217;aquestes millores als seus treballadors, heu de saber que en cas positiu, teniu perfecte dret a accedir &#8211; com qualsevol dels vostres companys &#8211; <strong>a les opcions de promoci\u00f3 i formaci\u00f3 professional<\/strong> que s&#8217;ofereixin dins de l&#8217;empresa, a les millores econ\u00f2miques i als ascensos. Tots hi tenim dret. En concret, <strong>30 dies naturals a l&#8217;any que s&#8217;han de pactar amb l&#8217;empresa<\/strong> de mutu acord. No en va, per a algunes organitzacions pot resultar especialment perjudicial que un treballador tri\u00ef fer les seves vacances en l&#8217;\u00e8poca de m\u00e9s feina.   <\/p>\n<p>Heu de saber, aix\u00f2 s\u00ed, que dins d&#8217;aquests 30 dies naturals hi ha 15 dies que s&#8217;han de gaudir durant el per\u00edode estival. Aix\u00ed i tot, sempre heu de tenir la possibilitat de <strong>negociar si voleu fer-les al juny, juliol, agost o setembre<\/strong>. Els 15 dies restants solen reservar-se per a altres \u00e8poques de l&#8217;any en qu\u00e8, per exemple, la c\u00e0rrega de feina \u00e9s menor. Sigui com sigui, la decisi\u00f3 final haur\u00e0 de ser consensuada per les dues parts.   <\/p>\n<p>Per facilitar aquest tipus de decisions <a href=\"https:\/\/woffu.com\/ca\/gestor-de-vacances-i-absencies\/\" target=\"_blank\" rel=\"noopener noreferrer\">existeixen eines tan \u00fatils com Woffu<\/a>. A trav\u00e9s d&#8217;aquesta plataforma, empleats i empleadors tenen l&#8217;oportunitat de negociar f\u00e0cilment els dies triats per a les vacances.
