La llei estableix que tots els empleats tenen dret a <strong data-start=\"436\" data-end=\"471\">30 dies naturals de vacances<\/strong> per any treballat (o la seva part proporcional), i aquest per\u00edode <strong data-start=\"532\" data-end=\"583\">no pot substituir-se per compensaci\u00f3 econ\u00f2mica<\/strong> mentre la relaci\u00f3 laboral segueixi vigent. <\/p>\n<p data-start=\"628\" data-end=\"1229\">A m\u00e9s, l&#8217;Estatut indica que l&#8217;elecci\u00f3 de les vacances s&#8217;ha de realitzar conforme al que recull el <strong data-start=\"734\" data-end=\"756\">conveni col\u00b7lectiu<\/strong> o, en defecte d&#8217;aix\u00f2, mitjan\u00e7ant <strong data-start=\"784\" data-end=\"831\">acord entre empresa i persona treballadora<\/strong>. L&#8217;empleat tamb\u00e9 t\u00e9 dret a con\u00e8ixer les seves dates de vacances amb <strong data-start=\"906\" data-end=\"942\">almenys dos mesos d&#8217;antelaci\u00f3<\/strong>. A la pr\u00e0ctica, l&#8217;empleat proposa els seus dies dins dels per\u00edodes permesos pel conveni o la pol\u00edtica interna, i l&#8217;empresa valida o ajusta la sol\u00b7licitud en funci\u00f3 de les necessitats organitzatives. El conveni col\u00b7lectiu t\u00e9 un paper determinant, ja que pot establir torns obligatoris, temporades preferents o sistemes de rotaci\u00f3.  <\/p>\n<p>Quan el conveni no regula res espec\u00edfic, la llei estableix que les vacances s&#8217;han de fixar de mutu acord. Aix\u00f2 significa que ni l&#8217;empresa pot imposar-les unilateralment ni l&#8217;empleat pot escollir-les sense respectar el procediment marcat. Alguns exemples habituals s\u00f3n: <\/p>\n<ul data-start=\"2457\" data-end=\"2911\">\n<li data-start=\"2457\" data-end=\"2601\">\n<p data-start=\"2459\" data-end=\"2601\"><strong data-start=\"2459\" data-end=\"2494\">Tancaments obligatoris d&#8217;empresa<\/strong> (per manteniment, parades t\u00e8cniques, tancaments per temporada, activitat molt baixa en un per\u00edode concret).<\/p>\n<\/li>\n<li data-start=\"2602\" data-end=\"2776\">\n<p data-start=\"2604\" data-end=\"2776\"><strong data-start=\"2604\" data-end=\"2647\">Necessitats organitzatives excepcionals<\/strong>, quan l&#8217;activitat productiva requereix una distribuci\u00f3 del descans molt concreta per garantir la continu\u00eftat del servei.<\/p>\n<\/li>\n<li data-start=\"2777\" data-end=\"2911\">\n<p data-start=\"2779\" data-end=\"2911\"><strong data-start=\"2779\" data-end=\"2804\">Vacances col\u00b7lectives<\/strong>, si aix\u00ed ho regula el conveni o s&#8217;ha pactat pr\u00e8viament amb la representaci\u00f3 legal dels treballadors.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"2913\" data-end=\"3262\">Encara que existeixin aquestes opcions, l&#8217;empresa no pot imposar els dies sense av\u00eds ni sense justificaci\u00f3, i sempre ha de respectar el termini de <strong data-start=\"3049\" data-end=\"3074\">preav\u00eds de dos mesos<\/strong>. En cas contrari, l&#8217;empleat podria reclamar judicialment.
