class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">La legislaci\u00f3 espanyola parteix d&#8217;una premissa clara: el descans \u00e9s un dret irrenunciable. El marc jur\u00eddic principal \u00e9s l&#8217;<\/span><b>Article 34 de l&#8217;Estatut dels Treballadors (ET)<\/b><span style=\"font-weight: 400;\">, per\u00f2 aquest s&#8217;ha de llegir sempre en conjunt amb la <\/span><b>Llei de Prevenci\u00f3 de Riscos Laborals<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<h3><span class=\"ez-toc-section\" id=\"Regulacio_en_lEstatut_dels_Treballadors\"><\/span><b>Regulaci\u00f3 en l&#8217;Estatut dels Treballadors<\/b><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><span style=\"font-weight: 400;\">L&#8217;ET estableix que tot treballador t\u00e9 dret a per\u00edodes de pausa per a prevenir la fatiga. No obstant aix\u00f2, un mat\u00eds d&#8217;expert que els RR.HH. han de considerar \u00e9s que aquesta normativa \u00e9s de <\/span><b>m\u00ednims de dret necessari<\/b><span style=\"font-weight: 400;\">. Aix\u00f2 significa que un contracte individual o un conveni col\u00b7lectiu pot millorar aquests descansos, per\u00f2 mai reduir-los. La jurisprud\u00e8ncia recent del Tribunal Suprem ha subratllat que la falta de registre d&#8217;aquests per\u00edodes inverteix la c\u00e0rrega de la prova: si no hi ha registre, es presumeix que no hi va haver descans.<\/span><\/p>\n<h3><span class=\"ez-toc-section\" id=\"Diferencia_entre_pauses_descansos_i_temps_efectiu_de_treball\"><\/span><b>Difer\u00e8ncia entre pauses, descansos i temps efectiu de treball<\/b><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><span style=\"font-weight: 400;\">\u00c9s vital que els departaments de persones gestionin aquesta distinci\u00f3 amb precisi\u00f3 t\u00e8cnica:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Temps de treball efectiu:<\/b><span style=\"font-weight: 400;\"> Aquell en qu\u00e8 el treballador est\u00e0 en el seu lloc i a disposici\u00f3 de l&#8217;empresari.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Pausa de jornada (interm\u00e8dia):<\/b><span style=\"font-weight: 400;\"> Breu interrupci\u00f3 per a necessitats b\u00e0siques o descans mental.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Descans per jornada (entre jornades):<\/b><span style=\"font-weight: 400;\"> El lapse necessari per a la recuperaci\u00f3 f\u00edsica completa.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>La clau del &#8220;Temps de Pres\u00e8ncia&#8221;:<\/b><span style=\"font-weight: 400;\"> En certs sectors (com transport o seguretat), existeix el temps on l&#8217;empleat no treballa per\u00f2 est\u00e0 &#8220;disponible&#8221;. Aquest temps t\u00e9 l\u00edmits espec\u00edfics i no ha de computar per al descans m\u00ednim obligatori.<\/span><\/li>\n<\/ul>\n<h2><b><img decoding=\"async\" class=\"alignnone size-medium wp-image-14040\" src=\"https:\/\/woffu.com\/wp-content\/uploads\/2025\/12\/Descanso-laboral-300x200.jpg\" alt=\"\" width=\"300\" height=\"200\" srcset=\"https:\/\/woffu.com\/wp-content\/uploads\/2025\/12\/Descanso-laboral-300x200.jpg 300w, https:\/\/woffu.com\/wp-content\/uploads\/2025\/12\/Descanso-laboral-1024x683.jpg 1024w, https:\/\/woffu.com\/wp-content\/uploads\/2025\/12\/Descanso-laboral-768x512.jpg 768w, https:\/\/woffu.com\/wp-content\/uploads\/2025\/12\/Descanso-laboral-900x600.jpg 900w, https:\/\/woffu.com\/wp-content\/uploads\/2025\/12\/Descanso-laboral-384x256.jpg 384w, https:\/\/woffu.com\/wp-content\/uploads\/2025\/12\/Descanso-laboral.jpg 1280w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/b><\/h2>\n<h2><span class=\"ez-toc-section\" id=\"Temps_obligatoris_i_tipus_de_descansos_en_la_jornada_laboral\"><\/span><b>Temps obligatoris i tipus de descansos en la jornada laboral<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">La casu\u00edstica varia segons el perfil de l&#8217;empleat i la naturalesa de la seva jornada.<\/span><\/p>\n<h3><span class=\"ez-toc-section\" id=\"Descans_dins_de_la_jornada_15_minuts_obligatoris_segons_el_cas\"><\/span><b>Descans dins de la jornada (15 minuts obligatoris segons el cas)<\/b><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Sempre que la jornada di\u00e0ria continuada excedeixi de <\/span><b>6 hores<\/b><span style=\"font-weight: 400;\">, \u00e9s obligatori un per\u00edode de descans no inferior a <\/span><b>15 minuts<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Punt d&#8217;expert:<\/b><span style=\"font-weight: 400;\"> Si la jornada \u00e9s de 6 hores exactes, no hi ha obligaci\u00f3 legal de pausa, llevat que el conveni ho indiqui.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Jornada partida vs. cont\u00ednua:<\/b><span style=\"font-weight: 400;\"> En jornades partides, el temps de menjar actua com a descans, per\u00f2 ha d&#8217;estar clarament delimitat en el quadrant horari per a no excedir la jornada m\u00e0xima.<\/span><\/li>\n<\/ul>\n<h3><span class=\"ez-toc-section\" id=\"Descans_entre_jornades_minim_12_hores\"><\/span><b>Descans entre jornades: m\u00ednim 12 hores<\/b><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Entre el final d&#8217;una jornada i el comen\u00e7ament de la seg\u00fcent, ha de mediar un m\u00ednim de <\/span><b>12 hores<\/b><span style=\"font-weight: 400;\">. Aquest \u00e9s un desafiament log\u00edstic en empreses amb <\/span><a href=\"https:\/\/woffu.com\/ca\/gestio-de-torns-i-horaris-de-treball\/\"><b>torns rotatius (mat\u00ed-tarda-nit)<\/b><\/a><span style=\"font-weight: 400;\">. Un error com\u00fa \u00e9s el &#8220;canvi de torn curt&#8221; (sortir a les 22:00 i entrar a les 06:00), el qual \u00e9s il\u00b7legal excepte en casos molt espec\u00edfics de torns especials regulats pel Reial Decret 1561\/1995.<\/span><\/p>\n<h3><span class=\"ez-toc-section\" id=\"Descans_setmanal_minim_dia_i_mig\"><\/span><b>Descans setmanal: m\u00ednim dia i mig<\/b><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><span style=\"font-weight: 400;\">El descans setmanal \u00e9s de <\/span><b>36 hores ininterrompudes<\/b><span style=\"font-weight: 400;\">. Encara que la llei esmenta que el gaudi preferent \u00e9s el diumenge, moltes empreses operatives 24\/7 el distribueixen de forma diferent. L&#8217;important \u00e9s que sigui acumulable per per\u00edodes de fins a 14 dies (treballar 11 dies i descansar 3 seguits, per exemple).<\/span><\/p>\n<h3><span class=\"ez-toc-section\" id=\"Normes_especifiques_per_a_menors_de_18_anys\"><\/span><b>Normes espec\u00edfiques per a menors de 18 anys<\/b><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><span style=\"font-weight: 400;\">La protecci\u00f3 al menor \u00e9s m\u00e0xima:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Si la jornada supera les 4,5 hores, el descans ha de ser de <\/span><b>30 minuts<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">El descans setmanal ha de ser de <\/span><b>2 dies ininterromputs<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Prohibici\u00f3:<\/b><span style=\"font-weight: 400;\"> No poden realitzar hores extraordin\u00e0ries ni treball nocturn, la qual cosa simplifica la seva gesti\u00f3 de descansos per\u00f2 rigiditza la seva planificaci\u00f3.<\/span><\/li>\n<\/ul>\n<h3><span class=\"ez-toc-section\" id=\"Consideracions_especials_en_torns_de_nocturnitat\"><\/span><b>Consideracions especials en torns de nocturnitat<\/b><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Un treballador nocturn no pot realitzar una jornada de m\u00e9s de 8 hores di\u00e0ries de mitjana en un per\u00edode de 15 dies. Tenen un l\u00edmit de 80 hores anuals per a protegir el descans del treballador. Una dada cr\u00edtica: les hores compensades amb descans dins dels 4 mesos seg\u00fcents <\/span><b>no computen<\/b><span style=\"font-weight: 400;\"> dins d&#8217;aquest l\u00edmit de 80.
