Constitueixen la refer\u00e8ncia principal sobre la qual es construeixen la resta de conceptes relacionats amb el temps de treball i, per tant, el punt de partida per a una gesti\u00f3 s\u00f2lida i defensable. <\/span><\/p>\n<h3><span class=\"ez-toc-section\" id=\"Definicio_legal_i_relacio_amb_el_contracte_de_treball\"><\/span><b>Definici\u00f3 legal i relaci\u00f3 amb el contracte de treball<\/b><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Des del punt de vista legal, les hores ordin\u00e0ries s\u00f3n aquelles que es presten dins de la jornada establerta en el <\/span><b>contracte de treball<\/b><span style=\"font-weight: 400;\">, respectant els l\u00edmits fixats per l&#8217;<\/span><a href=\"https:\/\/www.boe.es\/biblioteca_juridica\/abrir_pdf.php?id=PUB-DT-2025-139\"><b>Estatut dels Treballadors<\/b><\/a><span style=\"font-weight: 400;\"> i el <\/span><b>conveni col\u00b7lectiu aplicable<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Aix\u00f2 implica una realitat clau per a RR.HH.: no existeix una \u00fanica definici\u00f3 v\u00e0lida per a totes les empreses. La jornada ordin\u00e0ria dep\u00e8n del tipus de contracte, del conveni, de la distribuci\u00f3 del temps de treball i dels acords interns. En organitzacions grans, aquesta diversitat obliga a definir regles clares i, sobretot, a comptar amb sistemes capa\u00e7os d&#8217;aplicar-les de forma coherent i tra\u00e7able.<\/span><\/p>\n<h3><span class=\"ez-toc-section\" id=\"Diferencia_entre_hores_ordinaries_extraordinaries_i_complementaries\"><\/span><b>Difer\u00e8ncia entre hores ordin\u00e0ries, extraordin\u00e0ries i complement\u00e0ries<\/b><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Un dels errors m\u00e9s habituals en empreses complexes \u00e9s tractar qualsevol exc\u00e9s de jornada com un mateix concepte. La normativa distingeix clarament entre: <\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Hores ordin\u00e0ries<\/b><span style=\"font-weight: 400;\">, que formen part de la jornada habitual pactada.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Hores extraordin\u00e0ries<\/b><span style=\"font-weight: 400;\">, que excedeixen la jornada ordin\u00e0ria m\u00e0xima i estan subjectes a l\u00edmits i compensacions espec\u00edfiques.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Hores complement\u00e0ries<\/b><span style=\"font-weight: 400;\">, aplicables \u00fanicament a contractes a temps parcial i sota condicions molt concretes.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Confondre aquestes categories no genera nom\u00e9s un error puntual. A la pr\u00e0ctica, aix\u00f2 sol traduir-se en un m\u00e0xim anual que se situa entre <\/span><b>1.826 i 1.840 hores<\/b><span style=\"font-weight: 400;\">, en funci\u00f3 del conveni col\u00b7lectiu.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Per a RR.HH., el veritable repte \u00e9s <\/span><b>controlar aquest l\u00edmit de forma real i continuada al llarg de l&#8217;any<\/b><span style=\"font-weight: 400;\">. En empreses amb distribuci\u00f3 irregular de jornada, pics d&#8217;activitat o torns especials, el c\u00f2mput anual nom\u00e9s \u00e9s fiable si es recolza en dades precises i consolidades.<\/span><\/p>\n<h3><span class=\"ez-toc-section\" id=\"Obligacions_de_descans_entre_jornades_i_el_seu_impacte_en_el_comput\"><\/span><b>Obligacions de descans entre jornades i el seu impacte en el c\u00f2mput<\/b><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><span style=\"font-weight: 400;\">L&#8217;Estatut dels Treballadors exigeix un <\/span><b>descans m\u00ednim de 12 hores entre jornades<\/b><span style=\"font-weight: 400;\"> i un <\/span><b>descans setmanal d&#8217;1 dia i mig<\/b><span style=\"font-weight: 400;\">, acumulable en determinats sup\u00f2sits.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Aquests descansos no s\u00f3n opcionals ni accessoris. El seu incompliment no nom\u00e9s afecta el benestar del treballador, sin\u00f3 que exposa l&#8217;empresa a sancions i a la p\u00e8rdua de validesa del registre horari en cas d&#8217;inspecci\u00f3.<\/span><\/p>\n<h3><span class=\"ez-toc-section\" id=\"Pauses_durant_la_jornada_temps_efectiu_vs_no_efectiu\"><\/span><b>Pauses durant la jornada: temps efectiu vs. no efectiu<\/b><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Les pauses dins de la jornada, com l&#8217;\u00e0pat o els descansos breus, nom\u00e9s es consideren temps de treball efectiu quan aix\u00ed ho estableix el conveni, el contracte o la pol\u00edtica interna de l&#8217;empresa.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Quan aquestes pauses no es registren correctament, es produeix un dels problemes m\u00e9s habituals en empreses grans: les hores ordin\u00e0ries apareixen inflades. No garanteixen tra\u00e7abilitat, permeten modificacions sense control i dificulten enormement l&#8217;auditoria de la dada hist\u00f2rica. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">A major volum de plantilla, major \u00e9s el risc d&#8217;error acumulat i menor la capacitat de demostrar el compliment real amb informaci\u00f3 s\u00f2lida i verificable.
