Tanmateix, per als departaments de RR.HH., aix\u00f2 planteja un dilema jur\u00eddic: <\/span><b>Com donar llibertat total a l&#8217;empleat sense incomplir la Llei de Registre de Jornada?<\/b><\/p>\n<p><span style=\"font-weight: 400;\">El risc \u00e9s real. Les sancions de la Inspecci\u00f3 de Treball per registres inexistents o deficients poden assolir xifres considerables. El repte no \u00e9s nom\u00e9s &#8220;fitxar&#8221;, sin\u00f3 demostrar que, fins i tot en un entorn flexible, es <\/span><a href=\"https:\/\/woffu.com\/ca\/blog\/gestio-horari\/descansos-en-la-jornada-laboral-que-exigeix-la-llei-i-com-aplicar-ho-correctament\/\"><span style=\"font-weight: 400;\">respecten els descansos<\/span><\/a><span style=\"font-weight: 400;\"> i les jornades m\u00e0ximes. class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Jur\u00eddicament, la jornada flexible \u00e9s aquella que permet al treballador distribuir les seves hores de prestaci\u00f3 de serveis de manera no r\u00edgida, adaptant-se a les seves necessitats personals o a les fluctuacions de c\u00e0rrega de treball de l&#8217;empresa.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Segons l&#8217;<\/span><a href=\"https:\/\/www.boe.es\/biblioteca_juridica\/abrir_pdf.php?id=PUB-DT-2025-139\"><b>Estatut dels Treballadors<\/b><\/a><span style=\"font-weight: 400;\"> (espec\u00edficament despr\u00e9s de la reforma del Reial Decret-llei 8\/2019), la flexibilitat no eximeix de l&#8217;obligaci\u00f3 de registre. La normativa exigeix que el registre sigui fefaent, la qual cosa implica que ha de reflectir la realitat. Si un empleat t\u00e9 flexibilitat, el sistema de registre ha de ser capa\u00e7 d&#8217;absorbir aquesta variabilitat sense generar errors o alertes falses d&#8217;absentisme.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Tipus_de_jornada_flexible_per_a_empreses\"><\/span><b>Tipus de jornada flexible per a empreses<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">No totes les empreses necessiten el mateix model. Depenent del sector, la seva pol\u00edtica de jornada laboral i la cultura organitzacional, podem distingir tres grans tipus: <\/span><\/p>\n<h3><span class=\"ez-toc-section\" id=\"Flexibilitat_en_lentrada_i_sortida\"><\/span><b>Flexibilitat en l&#8217;entrada i sortida<\/b><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><span style=\"font-weight: 400;\">\u00c9s el model m\u00e9s com\u00fa. S&#8217;estableix una &#8220;franja de pres\u00e8ncia obligat\u00f2ria&#8221; (per exemple, de 10:00 a 14:00) i un marge flexible per a la resta de la jornada. Permet millorar la conciliaci\u00f3 familiar i reduir l&#8217;estr\u00e8s pel tr\u00e0nsit o el transport.  <\/span><\/p>\n<h3><span class=\"ez-toc-section\" id=\"Setmana_laboral_comprimida\"><\/span><b>Setmana laboral comprimida<\/b><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Consisteix a treballar el total d&#8217;hores setmanals en menys dies (per exemple, de dilluns a dijous). \u00c9s una opci\u00f3 ideal per a <\/span><b>sectors industrials<\/b><span style=\"font-weight: 400;\"> que busquen optimitzar torns o per al sector serveis que vol oferir el divendres tarda lliure com a incentiu.<\/span><\/p>\n<h3><span class=\"ez-toc-section\" id=\"Borsa_dhores_anual\"><\/span><b>Borsa d&#8217;hores anual<\/b><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Permet compensar per\u00edodes d&#8217;alta activitat amb altres de menor c\u00e0rrega. L&#8217;empleat pot treballar m\u00e9s hores en mesos punta i recuperar-les com a descans en \u00e8poques de baixa activitat. <\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Requisits_legals_i_registre_obligatori\"><\/span><b>Requisits legals i registre obligatori<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">La llei \u00e9s clara: <\/span><b>tota hora treballada ha de ser registrada<\/b><span style=\"font-weight: 400;\">. Quan implementem una jornada flexible, hem d&#8217;assegurar quatre punts cr\u00edtics per complir davant d&#8217;una inspecci\u00f3:<\/span><\/p>\n<ol>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Garantia de descans:<\/b><span style=\"font-weight: 400;\"> S&#8217;ha de respectar el descans m\u00ednim de 12 hores entre jornades.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><a href=\"https:\/\/woffu.com\/ca\/informes-de-recursos-humans\/\"><b>Disponibilitat de dades<\/b><\/a><b>:<\/b><span style=\"font-weight: 400;\"> Els registres s&#8217;han de guardar durant <\/span><b>4 anys<\/b><span style=\"font-weight: 400;\"> i estar disponibles immediatament per a l&#8217;inspector o els representants dels treballadors.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Inalterabilitat:<\/b><span style=\"font-weight: 400;\"> El sistema ha de garantir que les dades no han estat manipulades a posteriori.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Objectivitat:<\/b><span style=\"font-weight: 400;\"> El m\u00e8tode ha de ser clar i no donar peu a interpretacions ambig\u00fces sobre quan es va iniciar la jornada.<\/span><\/li>\n<\/ol>\n<h2><span class=\"ez-toc-section\" id=\"Com_gestionar_la_jornada_flexible_sense_perdre_el_control\"><\/span><b>Com gestionar la jornada flexible sense perdre el control<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Molts responsables de RR.HH. temen que la flexibilitat es converteixi en &#8220;caos&#8221;.
